A FEW WORDS ABOUT FEES & COSTS

There are in fact many different types of fee agreements for lawyer services. In addition to attorneys' fees, a client may also be responsible for costs and expenses incurred in the matter (such as court fees, courier fees, county recording fees). The following are some of the most common arrangements The Preble Law Firm utilizes.

Appointment Fees:

    The "Good Faith Fee"

    Our firm is fully committed to our existing clients and prides itself in providing full service in a timely manner. Although the $120 Good Faith Fee does not cover all the time and resources our firm invests in a potential client, it does help us qualify people who are serious about seeking our services, thus making our firm more time efficient.  A good faith fee is offered for the initial Estate Planning consultation and it is considered earned after the appointment is fulfilled. If you decide to hire the Preble Law Firm, the $120 is applied toward any fees that are agreed upon.

    The "Legal Options Consultation Fee"

    This $250 consultation fee is offered to any person or business seeking our counsel that can benefit from the advice that our firm can render in their particular situation during the allotted one hour period.

Contingency Fee

In a nutshell, the contingency fee arrangement is one whereby the attorney's compensation is based on a fixed percentage of any obtained recovery. However, often, in contingency fee agreements, there is a different fixed percentage applicable to each stage at which there might be a recovery. The usual set up is for a lower percentage during an early stage of obtained recovery (such as a recovery made before a lawsuit is filed), and higher percentage at a late stage (such as when a jury verdict has been made).

Flat Fee

A common flat fee arrangement is one whereby the full fee for a specified legal service is set at a specific dollar amount.

Hourly Fee

For our firm, skills and levels of experience are reflected in our attorneys' hourly rates. Hourly rate arrangements are set to bill a client for the different hourly rates for each of the lawyers, paralegals, and other personnel in the law firm who spend time on the client's matter.

Fees for Business and Property Law Matters

We offer flat fees for many business start-up matters and certain property law matters. In other business and property law matters, we charge based upon hourly rates or some other method approved, up front, by the client.

Fees for Estate and Personal Planning Services

Unlike some law firms, we do not have one set price for attorney-prepared estate and personal planning documents such as wills and trusts. This is because we custom-tailor such documents to suit client-specific circumstances, needs, and desires. In estate and personal planning matters, our fees are usually flat fees that are based upon how much work we estimate will be involved, the complexity of the matter, and whether the services are needed on a rush or emergency basis.

Fees for Probate Matters

Attorneys' fees for so-called "ordinary services" in formal probate matters in California are set by statute and are not set by the law firm or the client. Attorneys' fees for "extraordinary services" in formal probate matters in California are not set by statute but may, nevertheless, be limited or controlled by local court rules. Regardless of whether we are engaged in a formal probate matter (with or without extraordinary services) or any of the other types of probate matters, we discuss fees and costs up front.

Fees for Other Practice Areas

The fee arrangements we offer in matters involving other practice areas will vary from matter to matter and from client to client. We always discuss fee arrangements up front.
